MINUTES OF THE BOARD OF DIRECTORS MEETING OF WHITTIER OAKS HOMEOWNER’S ASSOCIATION HELD ON MONDAY, APRIL 20, 2009 AT THE NEW CITY HALL AT 7:00 P.M.
The minutes of the meeting of Whittier Oaks
Homeowner’s Association held on Monday, April 20, 2009 at the New City Hall at
7:00 P. M.
Prior to beginning the
meeting, Lt. Rosende of the Broward Sheriff’s Office gave a presentation about
crime in the community. The # 1 crime
conveyance is burglaries. There were
three car thefts and all were due to unlocked doors. They see personal items, equipment and other
items left in the car. He stated that
with the use of helicopters a few weeks ago they caught some burglaries with
the help of dogs. Some of the stolen
property was recovered. Terra Mar Park
had some incidents last week. A few
weeks ago there were some smash and bash, windows were broken and purses were
stolen from cars. Some criminals come
from South Miami. The Lt. left some
brochures, a newsletter and some prescription drub alert.
Lt. Rosende stated that BSO
has been on Hillsboro for the illegal parking and have written many tickets having
positive results.
The Lt. Was thanked for
coming to the meeting and bringing the information on the community.
Rodger Carver called the
meeting to order at 7:15 P. M.
Those present were Dominick
Peri, President, Carol St. Aubin, Vice President, Kevin Burger and Mark Harris,
Directors and Patricia Levis, Secretary.
Melissa Heller was absent with prior notice. Also present from Residential Management were
Rodger Carver and Anne Reyes.
Prior to beginning, Rodger
Carver stated that there is no statute that states that there should be a Good
& Welfare at the meeting and that it is not necessary to have more than the
Budget and Annual meeting but this Board does have monthly meetings. Rodger Carver stated that no outbursts would
be allowed at future meetings. If there
are questions, they could be asked and if they cannot be answered immediately,
Rodger Carver would get the answer.
Dominick Peri stated that he
had a letter of resignation from the Board from Ron Kent.
Dominick Peri moved to
accept the resignation of Ron Kent from the Board; seconded by Carol St.
Aubin. All in Favor. Motion carried.

Carol St. Aubin moved to
have Lisa Depace to fill the vacancy on the Board left by Ron Kent’s
resignation. Carol St. Aubin stated that
Lisa has lived in Whittier Oaks for twelve years, has been a President on the
Board of another Association, she has volunteered for being on the landscape
committee as well as making
it clear that if someone resigned from the Board, she would be interested in
taking the position.
Carol St. Aubins moved to
approve Lisa Depace to fill the vacancy left by Ron Kent’s resignation;
seconded by Marc Harris. All in
favor. Motion carried.
Lisa Depace accepted the
position to join the Board.
MINUTES
Mark Harris moved to waive
the reading of the minutes from the March 23, 2009 Board of Directors meeting
and to approve as corrected; seconded by Carol St. Aubin. All in favor.
Motion carried.
FINANCIALS
Rodger Carver stated that as
of April 20, 2009 the 1st United Bank Operating Account had a
balance of $9,712.62, the First Southern Bank had $43,669.96; the 1st
United Bank Reserve had $52,917.73, and due from the operating account was
$16,000.00. Therefore as of April 20,
2009 there was an Unaudited total of $122,300.31.
Rodger Carver also stated
that there was $97,330.27 in delinquent accounts. He also stated that a large amount of the
delinquency is due from foreclosed homes.
Mark Harris asked if
accounts are sixty days over what happens.
Rodger Carver replied that after thirty days it goes to collections.
A discussion about homes in
the community ensued.
Kevin Burger stated that
they should be concerned about the delinquencies but $about $45,000.00 is
current. It was stated that some
residents are under a stipulation agreement and are making monthly payments.
Mark Harris asked if
residents are being told that they can make arrangements.
Carol St. Aubin asked if the
new signs were ordered. Rodger Carver
stated that the check was issued.
She also asked if the sign
could be used to post a reminder to pay dues.
COMMITTEE REPORTS
PROPERTY
Rodger Carver stated that
Carol St. Aubins and he could meet weekly on Fridays to discuss the
community. He also reported that the
issues being worked on such as the lights on the pillar and

Island are being fixed. The timers were set to run 7:00 to 7:00 but
one is going on at 5:30. Ryan would be
back on Tuesday, to also fix roof tiles that needed work.
Rodger reported that the
violation list from the previous months a second letter was sent and some new
ones. He stated that he and Carol St.
Aubin’s would go to do a violation ride to review all violations once again.
Carol St. Aubins asked what
can be done to violators that do not comply?
Dominick Peri stated that
the Association must continue to send letters.
It was suggested to call Code Enforcement and talk to them to see if
they could help keep City of Parkland beautiful.
Although it may not be a
violation to code enforcement they may help intervene. Rodger Carver stated that he would call
them. He also suggested to go to the
Master Association for help.
Marc Harris stated that the
Board should be thinking of things that can be done to residents in order to
get them to pay. Dominick Peri stated
that the Association cannot take certain things away.
It could be stated that “as
a result of your delinquency you will lose your ----“ (could possibly state
that your lawn would be cut less). The letter should be addressed to each
homeowner.
Rodger Carver stated that he
spoke to Bell South. Carol stated that
they saw the metal boxes that need to have something planted around them. Bellsouth advised Rodger that they would not
pay for shrubs and that possibly years ago they might have but not now. Rodger Carver stated that he would try
customer service again.
LANDSCAPE COMMITTEE
Carol St. Aubin and Lisa
Depace walked by all the Islands. Carol
took pictures and stated sod is needed, weeds need to be killed and beds cut
back. Many things are dead. She recommended to have the plants removed,
close the beds and put mulch in. With
the pictures she has some recommendations for different plants. She also stated that she has quotes for sod
and mulch.
One is from NuTurf, they
were charging $275 down to $225.00.
A discussion about mulch and
how it would be put throughout the island, medians and entranceway ensued.
Nu Turf also gave a mulch
quote and one for spraying the beds.
$2400.00 for sod and $1400.00 for spraying.
Dominick Peri asked how may
pallets would they need. It was stated
about five pallets of sod would be needed.
The discussion continued
about sod, weeds, mulch and plants and if there was a good time for plantings.

Mark Harris moved to retain
NuTurf for spraying at an expense of $1400.00; seconded by Carol St.
Aubin. Prior to voting, Kevin Burger
wanted to discuss if there were funds to do this. Carol St. Aubin responded that she had
discussed this with Rita Barrett of Residential and the expense is in the
budget.
After the question was
answered the Board voted on the motion.
All in Favor, Motion Carried.
SOD- A discussion of costs
ensued. It was suggested to call a
company, The Sod Father. A discussion of
who to use and if they would cut in the sod continued.
Dominick Peri stated
Covenant would be the new landscaper and he would be around to do the cut in
and work.
Kevin Burger moved to
approve Covenant to put in sod at a cost of $200.00 per pallet not to exceed
five pallets; seconded by Carol St. Aubin.
All in favor. Motion carried.
A discussion about
collections and attorneys ensued and on Tuesday a copy of each proposal would
be sent to the board for review.
Dominick Peri returned the
books for the purchase of dog stations and signs in order to discuss what to
purchase and where the signs should be located.
Dominick Peri stated one should be put behind bushes near the entrance
across from his property. It was also
commented that the Janitorial Service would clean them out two times a week as
they are on property.
Carol St. Aubin made a motion
to approve the purchase of three (3) dog signs and two (2) receptacles to put
on certain islands to be determined at a later date; seconded by Lisa Depace.
Four members agreed, two
members disagreed. Motion Carried.
Prior to closing the
meeting, Dominick Peri stated that he would like to discuss the letter that was
written after the last meeting. At this
time he would not read the letter but it would be attached to the minutes and
posted on the Website. The Board decided
not to mail it but the Board all agreed to the letter.
There being no further
business before the Board, Kevin Burger moved to adjourn the meeting; seconded
by Patricia Levis. All in favor. Motion Carried.
The meeting was adjourned at
8:30 P.M.
